Terms of Service

1. Acceptance of Terms

By accessing or using Piqlo ("the Service"), operated by PiqloLabs, a sole proprietorship (eenmanszaak) based in Amsterdam, the Netherlands ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to enter into a paid subscription with Piqlo. You may use the free features from age 16; if you are under 18, you may only use the Service with the involvement and consent of your parent or legal guardian, who accepts these Terms on your behalf.

In these Terms, a consumer is an individual acting outside their trade, business, craft, or profession. A business customer is anyone else, including companies, sole traders, and professionals acting for business purposes. Some rights below, such as the right of withdrawal in section 6, apply only to consumers.

3. The Service

Piqlo provides a platform for creating, customizing, and tracking QR codes and NFC-linked smart URLs, including optional generated or animated QR artwork. We reserve the right to modify, suspend, or discontinue features with reasonable notice. We will notify you via email or in-app notice of material changes.

4. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at legal@piqlo.co if you suspect unauthorized access.

5. Acceptable Use

You agree not to use Piqlo to:

• Link to malicious, phishing, or illegal content
• Distribute malware, ransomware, or engage in fraud
• Create QR codes that redirect to deceptive or harmful destinations
• Violate intellectual property rights of third parties
• Abuse rate limits or attempt to circumvent security measures
• Generate automated, fake, or inflated scans, taps, analytics events, or redirects
• Use Piqlo as a general-purpose public URL shortener, traffic relay, or load-testing target
• Resell, sublicense, or pool one account across unrelated businesses without permission
• Abuse AI, image, GIF, upload, or storage features in a way that creates disproportionate cost or operational risk
• Scrape, bulk-extract, or reverse-engineer the Service
• Impersonate another person or entity
• Use the Service for any activity prohibited by applicable law

Some plans may be described as including unlimited cards, scans, redirects, or similar usage. "Unlimited" means ordinary human use for your own business or project. It does not include automated traffic, artificial scan inflation, resale, abuse, or usage that materially degrades the Service or creates unreasonable cost. We may throttle, pause non-essential features, request an upgrade, deactivate specific cards, or suspend an account when fair use is exceeded.

If you use Piqlo to collect personal data about your own customers (for example loyalty members or saved contacts), you are responsible for having a lawful basis to do so and for honouring your customers' data protection rights. Piqlo processes that data on your behalf under our Data Processing Agreement; see our Privacy Policy, section 2.

We reserve the right to deactivate QR codes, suspend accounts, or terminate access for violations of these terms without prior notice if the violation poses an immediate risk.

6. Payments & Subscriptions

Paid plans are billed monthly or annually via Stripe, as shown on the pricing page. By subscribing, you authorize recurring charges at the then-current rate until you cancel. Certain cost-sensitive features, including AI-generated QR artwork, uploads, and media processing, may have separate fair-use limits even when cards or scans are described as unlimited.

• Cancellation: You may cancel at any time. Access continues until the end of the current billing period, and you are not charged again after that. Outside the 14-day withdrawal period, cancelling stops future renewals; we do not refund the remaining part of a current paid period unless mandatory law requires it.
• Downgrades: If you exceed the limits of a lower plan, existing QR codes remain active but you cannot create new ones until you are within limits.
• Price changes: We will notify you at least 30 days before any price increase. Continued use after the effective date constitutes acceptance.

Right of withdrawal (EU consumers)

If you are a consumer in the EU, you may withdraw from your purchase within 14 days, for any reason. We do not make you wait: your subscription starts immediately so you can use Piqlo right away, and if you withdraw within those 14 days we refund you in full.

To withdraw, send us any clear statement of your decision before the 14-day period ends; an email to legal@piqlo.co is enough. You may also use the model withdrawal form below, but you do not have to. We refund within 14 days of being informed, to your original payment method, with no fee for the refund.

To PiqloLabs (eenmanszaak), legal@piqlo.co: I hereby give notice that I withdraw from my contract for the supply of the following service: Piqlo subscription, ordered on [date]. Name of consumer. Address of consumer. Signature (only if this form is notified on paper). Date.

Business customers (as defined in section 2) do not have a statutory right of withdrawal.

7. Intellectual Property

You retain ownership of the content you upload (logos, images). By uploading content, you grant PiqloLabs a limited license to process, store, and display it solely to provide the Service. We retain ownership of the Piqlo platform, branding, and all proprietary technology.

When you upload a GIF, logo, image, prompt, or other material, or when you ask Piqlo to generate AI QR artwork, you warrant that you have the right to use that content and that it does not infringe third-party rights. Uploaded and generated media is retained while the related card or account exists so we can display, download, re-render, and support the card, and it is deleted when the card or account is deleted. Third-party GIF search results or other externally sourced media may be subject to separate provider terms and must not be used commercially unless you have the necessary rights. Illegal content (including but not limited to CSAM, hate speech imagery, and copyrighted material used without permission) is strictly prohibited and may result in immediate account termination.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. If you use Piqlo to collect personal data about your own customers, our Data Processing Agreement (referenced in the Privacy Policy, section 2) forms part of these Terms and governs that processing. By using Piqlo, you acknowledge that you have read and understood the Privacy Policy.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance when possible. We are not liable for downtime, data loss, or service disruptions caused by factors beyond our control.

10. Termination

You may delete your account at any time via Settings > Delete Account. This permanently removes all your data.

We may suspend or terminate your account if you violate these Terms, with notice when feasible. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (liability, governing law, disputes) will survive termination.

11. Limitation of Liability

To the maximum extent permitted by law, Piqlo is provided "as is" and "as available" without warranties of any kind. We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities.

For business customers, our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 50, whichever is greater. For consumers, we do not cap our liability below what mandatory Dutch and EU consumer law requires, and your statutory remedies are not limited.

Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under mandatory applicable law. This includes liability for intent or gross negligence, for death or personal injury caused by our negligence, and your mandatory statutory rights as a consumer. For consumers, the cap and exclusions above apply only to the extent they are permitted under mandatory consumer law.

12. Indemnification

You agree to indemnify and hold PiqloLabs harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms. This indemnity does not apply to a consumer to the extent it would conflict with mandatory consumer law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance. If you disagree with updated Terms, you may delete your account before they take effect.

14. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from or related to the Service shall be subject to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands. This exclusive-forum clause applies to business customers. If you are a consumer, you may bring proceedings in, and may generally only be sued in, the courts of your country of residence, as required by EU law; nothing here removes that right.

For EU consumers: nothing in these Terms affects your statutory rights under applicable consumer protection laws, including the mandatory consumer protections of your country of residence. If we cannot resolve a dispute directly, you may be able to refer it to a competent consumer dispute-resolution body in your country of residence. (The EU Online Dispute Resolution platform was discontinued in 2025.)
